DOMKA Terms and Conditions

These Terms and Conditions (“Agreement”) govern the use of the DOMKA website, services, and products. By accessing or purchasing any DOMKA product, you agree to comply with and be bound by this Agreement. Please read these Terms carefully before proceeding with your purchase.

1. Definitions

“DOMKA,” “we,” “our,” and “us” refer to the company offering DOMKA products and services, including but not limited to DOMKA Home, DOMKA UNO, and DOMKA Home Plus units.
“You” or “your” refers to the individual or entity purchasing or inquiring about DOMKA products.

2. Purchase and Payment

By submitting a purchase order, you agree to pay for the DOMKA product at the listed price, plus any applicable taxes, delivery fees, or additional charges. Full payment is required before DOMKA can commit to manufacturing and delivery. Financing options are available and will be subject to approval by a third-party lender.

3. Delivery and Installation

Delivery: DOMKA units are typically delivered within 3-6 months of receiving the order, depending on manufacturing capacity and other factors. Delivery costs vary by location and will be communicated before purchase. Delivery charges typically range from $2,500 to $5,000, with additional costs for crane services.

Installation: Installation of the DOMKA unit requires the involvement of a general contractor. The contractor will be responsible for site preparation, including the pouring of a 22x20 ft concrete slab, utility hookups (water, sewer, electricity), and overseeing the proper setup of the unit on-site. The typical installation cost is approximately $25,000 per unit.

4. Site Preparation

Before the installation of your DOMKA unit, it is the customer’s responsibility to ensure that the site is properly prepared. This includes obtaining all necessary permits, preparing the 22x20 ft concrete slab, and ensuring the availability of water, sewer, and electrical connections. Costs for site preparation may vary based on location and other factors.

5. Warranty

Each DOMKA unit comes with a 25-year structural warranty covering manufacturing defects. The warranty does not cover damage caused by improper installation, misuse, or environmental factors such as floods or earthquakes.

6. Financing

Financing is available for qualified buyers. In order to qualify for financing, the buyer must own land where the DOMKA unit will be installed or have access to land where the unit will be placed. Financing terms, including interest rates and repayment schedules, are subject to approval by third-party lenders.

7. Permits and Zoning

It is the responsibility of the buyer to ensure that their land is zoned appropriately for the installation of a DOMKA unit. The buyer must also obtain all necessary permits and comply with local building codes. DOMKA is not responsible for delays or issues arising from zoning restrictions or permit approval.

8. Customization

DOMKA units are available with standard specifications. While some optional upgrades may be available (e.g., patio deck, sloped roof, additional insulation), customization options are limited. Additional costs for upgrades will be communicated prior to purchase.

9. Cancellation and Refunds

Orders may be canceled within 48 hours of payment for a full refund. After 48 hours, cancellations may incur a cancellation fee of up to 50% of the purchase price, depending on the status of the order and any incurred costs. Refunds will not be issued after production has started.

10. Limitation of Liability

DOMKA is not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the purchase, installation, or use of any DOMKA product. This includes, but is not limited to, damages for lost profits, use, data, or other intangible losses.

11. Force Majeure

DOMKA will not be held responsible for delays in delivery or installation due to events beyond our control, including but not limited to natural disasters, labor strikes, transportation issues, or government regulations.

12. Governing Law

This Agreement is governed by the laws of the State of Delaware, United States. Any disputes arising from this Agreement will be resolved in the appropriate courts in Delaware.

13. Modifications

DOMKA reserves the right to update or modify these Terms and Conditions at any time. All changes will be posted on this page with the date of the update. By continuing to use our website and services after changes are posted, you agree to the updated Terms and Conditions.
